Kapture

Legal

Terms of Service

Effective date: October 1, 2026

These Terms of Service ("Terms") are a legally binding agreement between you ("you") and Nikhil Kapur, an individual doing business as Kapture ("Kapture," "we," "us," or "our"). They govern your use of the Kapture website at kapture.dev and the Kapture apps for iPhone, iPad, Mac, and Apple Watch, including widgets and Shortcuts (together, the "Service").

By creating an account, tapping or clicking "Get started," or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you do not agree, do not use the Service.

1. The Service

Kapture helps you capture, structure, and tell the story of your work. You can record experiences by typing or by voice, turn them into structured stories with AI, review them in your library, practice with Interview Prep, talk with the Kanan career coach, and see your progress in KAP Stats and the Monthly Wrap. The Service is for personal career development.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years old.
  • Be able to enter into a binding agreement.
  • Not be barred from using the Service under the laws of the United States or where you live.
  • Not have had a Kapture account terminated for cause.

By using the Service, you confirm that you meet these requirements.

3. Your Account

You can sign up with an email address, Sign in with Apple, or Sign in with Google. You agree to:

  • Give accurate information and keep it up to date.
  • Keep your sign-in details private and not share your account.
  • Tell us right away at appsbykap@gmail.com if you think someone else has accessed your account.
  • Take responsibility for activity on your account.

One account per person. We may suspend or remove duplicate accounts.

4. Plans and Subscriptions

4.1 Plans

  • Free: a limited number of Kaptures each month and access to core features. Limits are shown in the Service and may change.
  • Pro: unlimited Kaptures plus Pro features such as KAP Stats, the Kanan career coach, and a monthly allowance of Switch Seats sessions, billed monthly or yearly.
  • Pro+ (Pro Plus): everything in Pro plus unlimited Switch Seats sessions, billed monthly or yearly.

The features included in each plan are described in the Service at the time you subscribe. Your plan applies on every device where you sign in to the same Kapture account, whether you subscribed through Apple or on our website.

“Unlimited” means no monthly cap for normal personal use. To keep the Service fast and fair for everyone, every account, on every plan, has a daily limit on AI requests (currently 200 a day, reset at midnight UTC) and short-term rate limits. We may adjust these limits to prevent abuse, and we will not lower the daily limit below what personal use needs.

4.2 Subscriptions bought in the Kapture apps (Apple)

  • Payment is charged to your Apple Account when you confirm the purchase.
  • The price is shown in your local currency on the purchase screen before you subscribe.
  • Your subscription renews automatically at the end of each period (monthly or yearly) unless you turn off auto-renew at least 24 hours before the current period ends. Your Apple Account is charged for renewal within 24 hours before the period ends.
  • You can manage or cancel your subscription in your Apple Account settings (on iPhone or iPad: Settings → your name → Subscriptions; on Mac: App Store → your name → Account Settings). Cancelling stops the next renewal. You keep access until the end of the period you paid for.
  • Refunds for App Store purchases are handled by Apple under Apple's policies. You can request one at reportaproblem.apple.com. Kapture cannot issue refunds for App Store purchases.
  • If you already have a subscription through our website, you do not need to buy one in the app. Manage each subscription where you bought it.

4.3 Subscriptions bought on kapture.dev (Stripe)

  • Fees are charged in United States dollars (USD) to the payment method you give Stripe, on a recurring basis at the then-current price.
  • Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date in Settings → Billing on kapture.dev, or by contacting us.
  • When you cancel, access continues through the end of the current period. Partial months are not refunded.
  • For yearly plans, if you cancel within 14 days of your first purchase or a yearly renewal, you can ask for a pro-rated refund of the unused time by emailing us at appsbykap@gmail.com within those 14 days. After 14 days, yearly plans are non-refundable.
  • Deleting your account cancels a subscription bought on our website.

4.4 Price changes

We may change prices. For website subscriptions, we will give you at least 30 days' notice by email or in the Service. For App Store subscriptions, Apple notifies you of price changes and, where required, asks for your consent before the new price applies.

4.5 Terminated accounts

If we terminate your account for violating these Terms, we do not refund website subscription fees for the remaining period.

5. Acceptable Use

Use the Service only for lawful purposes. You agree not to:

  • Break any law or regulation.
  • Submit content that is unlawful, defamatory, obscene, harassing, or fraudulent, or that infringes someone else's intellectual property or privacy.
  • Submit confidential or trade secret information belonging to your employer or anyone else that you do not have the right to share.
  • Try to access parts of the Service, its systems, or other people's accounts without permission.
  • Reverse engineer, decompile, or try to extract the source code of the Service, except where the law allows it.
  • Scrape or use automated tools to pull data from the Service.
  • Use the Service to build a competing product, or benchmark it commercially without our written permission.
  • Resell or sublicense access to the Service.
  • Upload viruses or other harmful code.
  • Impersonate anyone or misrepresent your affiliation with anyone.
  • Get around plan limits or other technical limits.

6. Your Content

"User Content" means everything you submit or create in the Service, including your Kaptures (your stories and their structured results), voice captures once transcribed, coaching messages, Interview Prep answers, profile details, and network details.

You keep ownership of your User Content. You give Kapture a limited, non-exclusive, worldwide, royalty-free license to store, process, send to our AI provider, and display your User Content only as needed to provide the Service to you. This license ends when you delete the content or your account.

You confirm that you have the right to submit your User Content and that it does not break any law or anyone's rights. We do not claim ownership of your User Content, and we do not use it to train AI models.

7. AI-Generated Content

The Service uses AI, specifically Anthropic's Claude models, to create career content such as story summaries, resume bullets, interview answers, coaching replies, and monthly summaries ("AI Content"). You understand that:

  • AI Content can be wrong, incomplete, or out of date. We do not guarantee its accuracy or that it fits any purpose.
  • AI Content is for personal career development and information only. It is not professional career, legal, HR, employment, financial, or psychological advice.
  • You are responsible for reviewing AI Content before you use it anywhere, including resumes, job applications, LinkedIn, performance reviews, and interviews.
  • Kapture is not responsible for outcomes, such as hiring decisions or effects on your reputation, that come from your use of AI Content.
  • You should not submit sensitive, classified, or privileged information, confidential employer data, trade secrets, or other people's personal information without their consent.

8. Our Intellectual Property

The Service, including its software, design, graphics, and content we create (not your User Content), belongs to Nikhil Kapur and is protected by intellectual property laws. "Kapture," the "K" logo, and related brand assets are ours. These Terms give you only the limited right to use the Service as described. You may not use our brand without written permission.

9. Third-Party Services

The Service works with third-party services, including Apple (App Store, Sign in with Apple), Supabase (database and sign-in), Anthropic (AI processing), Stripe (website payments), and Google (Sign in with Google). Their own terms and privacy policies also apply when you use them. We are not responsible for what those services do.

10. Availability and Changes to the Service

We work to keep the Service available, but we do not promise it will always be available or error-free. We may change, pause, or stop any part of the Service. We will try to give reasonable notice of significant changes or planned downtime.

11. Changes to These Terms

We may update these Terms. For material changes, we will update the effective date and tell you by email or an in-app notice. If you keep using the Service after the effective date, the updated Terms apply.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT THE LAW ALLOWS, KAPTURE AND NIKHIL KAPUR DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR NEEDS, THAT RESULTS WILL BE ACCURATE OR RELIABLE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS. NO ADVICE OR INFORMATION YOU GET FROM KAPTURE OR THE SERVICE CREATES ANY WARRANTY NOT STATED IN THESE TERMS.

13. Limitation of Liability

TO THE FULLEST EXTENT THE LAW ALLOWS, KAPTURE, NIKHIL KAPUR, AND OUR SERVICE PROVIDERS, AGENTS, AND LICENSORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, OR THE COST OF SUBSTITUTE SERVICES, EVEN IF TOLD SUCH DAMAGES WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE FEES YOU PAID KAPTURE IN THE 12 MONTHS BEFORE THE EVENT THAT LED TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

THESE LIMITS APPLY UNDER ANY LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO SOME MAY NOT APPLY TO YOU.

14. Indemnification

You agree to defend, indemnify, and hold harmless Kapture, Nikhil Kapur, and our successors and assigns from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (i) your use of the Service; (ii) your User Content; (iii) your breach of these Terms; (iv) your violation of any law or anyone's rights; or (v) any claim that your User Content harmed someone. We may take over the defense of any such matter, and you agree to cooperate with us.

15. Termination

We may suspend or terminate your access at any time, with notice where reasonably possible, including for breaking these Terms, fraud, abuse of the Service, or harm to others.

You can close your account at any time. In the apps: Settings → Account → Delete Account. On the web: Settings → Privacy → Delete account. Deleting your account permanently removes your data as described in our Privacy Policy. It does not cancel an App Store subscription; cancel that in your Apple Account settings.

When your account ends, your right to use the Service ends. Sections 6 (the license ends when content is deleted), 7, 8, 12, 13, 14, 16, 17, 18, and 19 survive.

16. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law rules. Subject to Section 17, any legal action not subject to arbitration must be brought only in the state or federal courts in Dallas County, Texas, and you agree to the personal jurisdiction of those courts.

17. Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for claims that qualify for small claims court, any dispute relating to these Terms, the Privacy Policy, or the Service, including whether these Terms are valid or enforceable, will be resolved by final and binding arbitration instead of in court.

Try to resolve it first. Before starting arbitration, you and Kapture agree to try to resolve the dispute informally for at least 30 days. Send a written notice describing the dispute and the relief you want to appsbykap@gmail.com with a subject line starting “KAPTURE: Dispute”. We will send notices to the email address on your account.

The American Arbitration Association ("AAA") will administer the arbitration under its Consumer Arbitration Rules (adr.org). The arbitration will take place in Dallas, Texas. At your request, it can be held by phone, by video, or on written submissions alone. The arbitrator's decision is final and may be entered as a judgment in any court with jurisdiction.

You and Kapture each give up the right to a jury trial for disputes covered by this section. Either party may still ask a court for emergency injunctive relief to prevent irreparable harm while arbitration is pending.

Your right to opt out. You can opt out of this arbitration agreement by emailing appsbykap@gmail.com within 30 days of first accepting these Terms, with a subject line starting “KAPTURE: Arbitration opt out” and the email address on your account. Opting out does not affect any other part of these Terms. If you opt out, Section 16 (governing law and courts) applies to disputes instead.

YOU AND KAPTURE AGREE THAT ANY DISPUTE WILL BE HANDLED ONLY ON AN INDIVIDUAL BASIS. NEITHER OF US MAY BRING OR JOIN A CLASS ACTION, CONSOLIDATED ACTION, OR MASS ARBITRATION, ACT AS A PRIVATE ATTORNEY GENERAL, OR COMBINE CLAIMS WITH ANYONE ELSE WITHOUT BOTH PARTIES' WRITTEN CONSENT. IF THIS WAIVER IS FOUND UNENFORCEABLE FOR A PARTICULAR CLAIM, THAT CLAIM WILL BE SEPARATED AND DECIDED IN COURT, AND ALL OTHER CLAIMS WILL STAY IN ARBITRATION.

18. Apple App Store Terms

These terms apply if you downloaded Kapture from the Apple App Store:

  • Parties. These Terms are between you and Kapture only, not Apple. Kapture, not Apple, is solely responsible for the app and its content.
  • License. You receive a non-transferable license to use the app on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. The app may also be used by other accounts associated with you through Family Sharing or volume purchasing where those features apply.
  • Maintenance and support. Kapture is solely responsible for maintenance and support of the app. Apple has no obligation to provide any maintenance or support.
  • Warranty. If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs, or expenses from a failure to meet a warranty are Kapture's responsibility, to the extent these Terms do not disclaim them.
  • Product claims. Kapture, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
  • Intellectual property claims. If a third party claims that the app or your use of it infringes their intellectual property rights, Kapture, not Apple, is solely responsible for investigating, defending, settling, and resolving that claim.
  • Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Developer contact. Questions, complaints, or claims about the app go to Kapture at appsbykap@gmail.com.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.

If these Terms conflict with the Apple Media Services Terms and Conditions for App Store purchases, Apple's terms control for those purchases.

19. General

Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and Kapture about the Service and replace any earlier agreements.

Severability. If any part of these Terms is found unenforceable, the rest stays in effect, and that part is changed only as much as needed to make it enforceable.

No waiver. If we do not enforce a right, we have not given it up. Any waiver must be in writing and signed by Kapture.

Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours, including as part of a merger, acquisition, or sale.

Force majeure. We are not liable for delays or failures caused by events outside our reasonable control, such as natural disasters, pandemics, government action, internet failures, or outages at our service providers.

Notices. We send notices to the email address on your account. Send notices to Kapture at appsbykap@gmail.com.
